Did I start the relationship out of fraud?  Did I know she was mentally unstable?  Did I cheat on her because I thought it would be funny?

If I answer yes to those, then I probably should face some consequences.

I don't think this woman should be accountable for murder or manslaughter, but she should face some consequences for her actions.
Ok lets break this down

" Did I ever start a relationship out of fraud"?...........Raise your hand if you didn't pretend to start a relationship for nothing more than sex....well there is your fraud

"Did I know she was mentally unstable"?..........Raise your hand if you have never been with a chick that wasn't emotionally questionasble....well, there is mental issues

"Did I cheat on her because I thought it would be funny"?..Ummmmmmmmm maybe not, but raise your hand who has never cheated on someone. It hurts regardless of the reason. So there is your cheating.

Nowwhat consequences should we all face?

Yes, that is true.  B.Schuss has already pointed out a few times that this law extends harassment laws to cover digital mediums.  I don't see a huge problem here.

Regardless, this woman did fraud and harass that girl.  If this had been a conman who got someone to 'agree' to give up their life savings, would you feel differently?

OK.  I thought it was implied, but I will add it anyway-- was there malicious intent involved?

lowing wrote:

That woman knew the girl had been diagnosed with various mental disorders.  Being a woman is not a recognized mental illness.

It's not as reasonable to expect not to be emotionally bullied. Bullying is endemic amongst children - a natural occurrence and symptom of immaturity. Killing/abduction/molestation is an extreme rarity practiced only by a few of unnatural and unsound mind.
Is there always going to be some level of bullying?  Of course.  And everyone now and then a kid walking home from school will be kidnapped, brutally raped, and killed.  Fact of life.  But there should be a reasonable belief that it won't happen.  That is: the risk should (and can) be statistically insignificant.

I don't believe in punishing, say, an 11 year old with incarceration for stupid immaturity.
Leading someone to suicide generally goes well beyond stupid immaturity, and when it doesn't there's unlikely to be a custodial sentence.

Your 'combatting the culture' idea was far better than this.
But they're two sides of the same coin: you can't combat culture without legislating behaviour, nor can you effectively legislate behaviour without combating culture (a trap many authority figures fall into).

Senor.........We are talking about MYSPACE.........It is a fantasy nothing more..........99% of the people on it are not who they claim to be....If people want to emerse themselve into BULLSHIT, and then kill themselves over it, there is not a whole lot anyone can do about it....This girl would have killed herself eventually over something, that is pretty clear........It just happened to be over fantasyland........

Again lowing sensationalizing stuff. All they did was remove the requirements for harassment to be in person. Harassment has ALWAYS been against the law, next you going to claim someone getting sued for slander is a new thing and has never happened before.

How many people on MySpace collect a group of people to create a profile to completely fuck with someone who they know?  Teenagers do that kind of crap to each other.  What makes this different is that a parent did it.

It was done solely out of malicious intent, and the fact that they knew the person and her vulnerabilities makes it criminal.  MySpace or not, that kind of shit should be punishable.

Well shit, back in the day if someone gave you harrassing or crank phone calls, you changed your number..........How about the novel idea that if you are fucked with on MYSPACE, you stay the hell off of it?? Pretty cool huh? The notion that you can solve your own problem with one click, or in her case, the absence of one click is mind blowing.......REAL life should be so fucking easy

The death, while tragic, is not the crime.  The crime here is in the events leading up to her suicide.  That woman should be held accountable for her actions.  She did not kill the girl, but she certainly harassed and emotionally abused her with malice.  That is the crime for which she should be charged.

Why the fuck should someone have to change their phone number, something that presumable all their friends and family use to keep in contact with them to stop one prick from harassing them?

Seriously if you genuinely think people should be allowed to force others into doing something they don't want to stop some sort of bad consequence.

You know what other crimes that sounds like?

Blackmail, terrorism, mugging, to name a few.

Let me take you back a few years before the internet and cell phones...........Back to a day when people actually interacted in real life and did not see a need to be wired up like a fuckin' stereo. There was once a day when people actually MISSED a phone call, and the other person would simply have to call back later. There used to be a day where people had no idea who the fuck was calling until they picked up the fuckin' phone.

In other words, back in the day, real life interaction was the going trend and to change your phone number was no big deal, you simply gave your new number to thoe you wished to have it.

All this girl hadda do was stay off of MYSPACE, hell, even start a new profile ( change her number) see? I am a problem solver

Yes.  That's all she had to do, and she made the ultimate bad decision.  The crime is not her suicide.  The crime was the malicious harassment perpetrated by her friend's mother.

Wow, looking back and I can't seem to find anywhere where we were talking about constitutional rights! I thought we were talking about some fucked up kid that got emersed in a bullshit teeniebopper fantasy world called MYSPACE and killed herself over some BULLSHIT boyfriend she never even met in real life.........I had no idea we were discussing the constitution here.

I believe it is her right to have forms of communication with others without them being open to harassment, hence the law of harassment... all they did was remove the to someones face part of it.

Your allowed to hurt other peoples feelings, your not allow to harass them. Simple as, its been law for a long time, so I dont see what you are so surprised about.

The point being she CHOSE to keep going back for more, she didn't even know "Josh" in real life and she killed herself over him? She could have very easily prevented all of it by just staying the fuck off of MYSPACE, or changing her profile and moving on

You can not be harrassed online when you have the ability to simply and LITERALLY click your way out of any situation. She was not a prisoner, she went where she knew she would be harrassed....all she had to do was not go there.

Oh I see so now we are not talking about constitutional rights anymore, merely what you believe to be morally right. Well that is different.

Correct me if I am wrong, because I do not use MYSPACE but can you add and take away from your list of "friends"? Can you not "block" someone from seeing if you are online. Can you not refuse incoming messages from those you do not wish to talk to? Can you not delete those that are not your friends?

As an account holder she was in control of all of here "friends" and their communications..So if you ask me she exercised her "moral right" to communicate. She CHOSE to do so with idiots such as herself.

This is an interesting development.  But not a stretch.

The bill isn't about free speech, its about stalking someone on the internet...which is already covered in laws via telephone harrassment, etc.  So hopefully the law will prevent stalkers, although I would say this isn't "against the law to say mean things".  It's you can't stalk.
