No.  Some of these aircraft would have had their altitude adjusted as it moved from sector to sector.  Since this could not happen fast enough, some planes almost got too close.  My question is, if planes did collide, who would be at fault?

What a coincidence, two American pilots were recently allowed to leave the country. Their passports had been confiscated during the investigation of Brazil's worst airline crash. They were flying a brand new Embraer Legacy private jet when their wing clipped an Airbus. The airbus crashed killing some 150 passengers and crew. The Legacy made an emergency landing on a nearby air base, with minor damages.

I don't have time to search, but you should find it in the news. Air traffic and the pilots actions are being investigated. It has come up during the investigations that several times this year planes here were in violation of  flight traffic rules of horizontal and vertical minimal distances.

That'd be Air Traffic Control at fault, pilots just do what they're told and if what they're told is wrong they do their best to get out of it. Unless of course the pilot was told to do one thing and then did something else, but if they were following ATCs requests then it's not their mistake.
